Terms of Service

1. Acceptance of Terms

Welcome to Paymetopost ("Company", "we", "our", or "us"). By accessing or using the Paymetopost website located at paymetopost.com or our associated web application at app.paymetopost.com (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you and Paymetopost. We reserve the right to modify these Terms at any time. Continued use of the Platform after any modification constitutes your acceptance of the revised Terms.

2. Description of Service

Paymetopost is a performance-based creator marketplace that connects content creators ("Creators") with brands and advertisers ("Brands"). Creators browse available paid social media tasks, publish original content on their own TikTok and/or Instagram accounts, and earn compensation tied to verified engagement metrics such as likes, views, and post performance. Brands use Paymetopost to create, manage, and fund content campaigns.

3. Eligibility

You must be at least 18 years of age to use the Platform. By agreeing to these Terms, you represent and warrant that:

  • You are at least 18 years old.
  • You have the legal capacity and authority to enter into a binding contract.
  • Your use of the Platform does not violate any applicable laws or regulations.
  • All information you provide to Paymetopost is accurate, current, and complete.

We reserve the right to refuse access to the Platform to any person for any reason at our sole discretion.

4. Account Registration

You must create an account to use the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate and truthful registration information.
  • Notify us immediately of any unauthorized use of your account.
  • Not share your account credentials with any third party.
  • Not create more than one account per person.

Paymetopost may suspend or terminate your account at any time if we believe you have violated these Terms.

5. Creator Terms

5.1 Application and Approval

Access to paid tasks on the Platform requires approval by Paymetopost. Approval is granted at our sole discretion based on account quality, content history, audience metrics, and adherence to platform standards. Approval may be revoked at any time.

5.2 Linking Social Media Accounts

To participate as a Creator, you must connect your TikTok and/or Instagram account to the Platform. By linking your social media accounts you:

  • Authorise Paymetopost to access the data and metrics associated with your connected accounts via TikTok for Developers APIs and Meta/Instagram Basic Display API, including but not limited to public profile information, post metrics (likes, views, comments, shares), audience demographics, and account analytics.
  • Confirm that you are the rightful owner or authorised user of the connected account.
  • Agree that your access tokens will be stored securely and used solely to verify and track post performance for tasks you have accepted.
  • Understand that you may revoke this access at any time through your social media platform settings, but doing so may prevent the Platform from verifying your submissions or processing payouts.

5.3 Task Acceptance and Content Creation

By accepting a task, you agree to publish original content that meets the task brief requirements on your linked social media account(s). You must:

  • Publish content that complies with the brand brief, TikTok Community Guidelines, Instagram Community Standards, and all applicable advertising disclosure requirements (e.g., #ad, #sponsored).
  • Keep the published content live for the full duration specified in the task brief, unless instructed otherwise.
  • Not artificially inflate engagement metrics through bots, purchased likes, follow/unfollow schemes, or any other inauthentic means.
  • Submit only content that is your own original work and does not infringe the intellectual property rights of any third party.

5.4 Creator Rank and Gating

Paymetopost operates a rank-based system (Bronze, Silver, Gold, Platinum) that determines which tasks a Creator may access. Rank is calculated based on verified post performance and compliance history. Task access, pay multipliers, and platform perks are tied to rank. Rank scores are updated periodically and are at the sole discretion of Paymetopost.

6. Brand / Advertiser Terms

Brands using the Platform to create and fund campaigns agree to:

  • Provide accurate campaign briefs that comply with TikTok Advertising Policies, Meta Advertising Standards, and all applicable advertising laws.
  • Ensure sufficient funds are loaded or authorised before activating a campaign.
  • Not require Creators to post content that is misleading, harmful, discriminatory, or otherwise unlawful.
  • Accept that Paymetopost does not guarantee any specific engagement outcome for any campaign.

7. Social Media Platform Integrations

The Platform integrates with third-party social media services including TikTok (operated by ByteDance Ltd) and Instagram (operated by Meta Platforms, Inc.). Your use of these integrations is also subject to the terms and policies of those platforms:

We use TikTok's and Instagram's official APIs strictly within the scope of permissions granted by you during the OAuth authorisation flow. We do not store raw API credentials and we comply with the developer usage policies of each platform.

8. Payment Terms

Paymetopost pays Creators based on verified engagement metrics (e.g., likes and/or views) generated by approved posts, subject to:

  • Payout schedule. Payouts are processed on a weekly basis (every Monday) for all earnings verified in the preceding week. Paymetopost reserves the right to adjust the payout schedule with reasonable notice.
  • Minimum threshold. A minimum earnings balance may be required before a payout is initiated. The current threshold is displayed in your account dashboard.
  • Verification. All posts must pass an internal review before earnings are confirmed. Paymetopost reserves the right to withhold or reverse payments for posts found to violate these Terms or the relevant platform's guidelines.
  • Taxes. You are solely responsible for reporting and paying any applicable taxes on income earned through the Platform. Paymetopost may request tax information (e.g., W-9 or equivalent) as required by applicable law.
  • Adjustments. Paymetopost may adjust, withhold, or reverse earnings if engagement is determined to be inauthentic, if content is removed or violates platform policies, or if there is a suspected breach of these Terms.

9. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to circumvent, disable, or interfere with the security features of the Platform.
  • Use automated bots, scrapers, or crawlers to access the Platform without our express written consent.
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
  • Artificially inflate or manipulate engagement metrics on any post submitted through the Platform.
  • Engage in any conduct that could damage, disable, overburden, or impair the Platform or its servers.
  • Attempt to reverse-engineer, decompile, or disassemble any portion of the Platform.
  • Post, transmit, or submit any content that is defamatory, obscene, hateful, threatening, or that infringes the rights of any third party.

10. Intellectual Property

All content, design, graphics, software, and materials on the Platform are the property of Paymetopost or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

By submitting content through the Platform (including post URLs and associated media), you grant Paymetopost a non-exclusive, worldwide, royalty-free licence to use, display, and analyse such content solely for the purpose of operating the Platform and verifying your submissions.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. PAYMETOPOST DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PAYMETOPOST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PAYMETOPOST IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless Paymetopost and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) your content or posts; or (d) your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform immediately ceases. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) shall survive.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in any court of competent jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" at the top of this page and, where appropriate, notify you by email or in-app notice. Your continued use of the Platform after changes take effect constitutes your acceptance of the new Terms.
